I. Reservation & Booking Agreement
By completing a reservation with Executive Inn Express ("the Hotel"), you ("the Guest") agree to be bound by these Terms and Conditions in their entirety. A reservation is confirmed upon the Hotel's issuance of a written confirmation number to the email address provided by the Guest. To complete a reservation, the Guest must provide a valid payment card, which is securely tokenized and held on file via the Hotel's PCI-compliant payment processor (Stripe, Inc.); the Hotel does not store full card numbers on its own systems. No funds are charged at the time of booking. The full room rate, applicable taxes, and any required deposit are charged at check-in, except where these Terms expressly authorize the Hotel to charge the card on file at another time (including, without limitation, the cancellation, no-show, damage, and incidentals provisions of Sections II, IV, and V).
II. Cancellation, Late Cancellation & No-Show
Free cancellation. Guests may cancel their reservation without penalty and at no charge by notifying the Hotel no later than 48 hours prior to the scheduled check-in date and time (Central Time). Cancellations must be communicated by telephone or email to the Hotel, and the Guest must obtain a cancellation confirmation number to evidence the cancellation. Where notice is given within this window, no amount will be charged to the card on file and any pending authorization hold will be released.
Bookings made within 48 hours of arrival. Where a Guest creates a reservation less than 48 hours before the scheduled check-in date and time, the reservation is non-refundable from the moment of booking; the free-cancellation window in the preceding paragraph does not apply. The Guest acknowledges and authorizes that, for any such reservation, the Hotel may charge the card on file the full room rate plus all applicable state and local taxes in advance of the scheduled arrival, in whole or in part, at the Hotel's discretion. Any unused portion will be refunded only in accordance with Sections II (Late cancellation / No-show) and III (Hotel cancellation prior to arrival).
Late cancellation (within 48 hours). Cancellations made less than 48 hours before the scheduled check-in date and time are non-refundable. The Guest authorizes the Hotel to charge the card on file an amount equal to one (1) night's room rate plus all applicable state and local taxes. No further amount is owed for the remaining nights of the cancelled reservation.
No-show. If the Guest fails to arrive on the scheduled check-in date and has not cancelled the reservation, the Guest authorizes the Hotel to charge the card on file an amount equal to one (1) night's room rate plus all applicable state and local taxes as a no-show fee. The remaining nights of the reservation are released back into inventory and no further amount is owed for those nights. Repeated no-shows by the same Guest may, at the Hotel's discretion, result in the Guest being declined future reservations.
Charges under this Section II will appear on the Guest's card statement as originating from Executive Inn Express. The Guest acknowledges that submitting a reservation through the Hotel's website constitutes affirmative consent to these charges as off-session transactions on the saved payment method.
III. Hotel's Right to Refuse, Modify, or Cancel Reservations
The Hotel expressly reserves the right, in its sole and absolute discretion and at any time before or during a Guest's stay, to refuse service, refuse entry, modify, shorten, relocate, or cancel any reservation for any lawful reason, including but not limited to:
- operational necessity, maintenance requirements, or loss of room inventory;
- force majeure events, including without limitation fire, flood, severe weather, power or utility failure, labor disruption, public-health emergency, or order of any governmental or public-health authority;
- overbooking or a reasonable-faith determination that the Hotel cannot accommodate the reservation as booked;
- the Guest's failure to provide, at check-in, a valid government-issued photo ID matching the name on the reservation;
- suspected or actual fraudulent, unlawful, disruptive, intoxicated, threatening, abusive, or harassing conduct by the Guest or any member of the Guest's party, whether directed at staff, other guests, or the Hotel's property;
- violation of the House Policies set forth in Section V of these Terms, or of any posted rules of the Hotel;
- any circumstance that the Hotel reasonably determines may pose a risk to the safety, security, health, comfort, or quiet enjoyment of other guests, of staff, or of the Hotel's property.
Where the Hotel cancels or refuses a reservation prior to the Guest's arrival, the Hotel will make reasonable efforts to notify the Guest at the contact information on file, will refund in full any amounts the Guest has paid to the Hotel toward that reservation, and will release any pending authorization hold or saved payment method on file. Where the Hotel terminates a reservation during the Guest's stay for cause (including violation of House Policies or conduct described above), the Guest remains responsible for room charges, taxes, deposits, and any damage charges incurred through and including the date of termination, the Guest authorizes the Hotel to charge those amounts to the card on file, and the Guest forfeits any refund for the remaining nights.
Non-discrimination. The rights reserved in this Section III shall not be exercised in any manner that violates the federal Civil Rights Act of 1964 (42 U.S.C. § 2000a et seq.), the Arkansas Civil Rights Act of 1993 (Ark. Code Ann. § 16-123-101 et seq.), the Americans with Disabilities Act, or any other applicable federal, state, or local anti-discrimination law. No refusal or cancellation of service shall be made on the basis of race, color, religion, national origin, ancestry, sex, gender identity, sexual orientation, pregnancy, disability, or any other characteristic protected by applicable law.
IV. Check-In, Check-Out, Card on File & Payment
Standard check-in is 2:00 PM Central; check-out is 11:00 AM Central. Early check-in and late check-out are subject to availability and may carry an additional charge. At check-in, Guests must present a valid government-issued photo ID matching the name on the reservation. The Hotel reserves the right to refuse check-in where ID is not presented or where the ID presented does not match the reservation.
Card on file. By completing a reservation, the Guest provides a valid payment card and authorizes the Hotel to retain that card on file via the Hotel's PCI-compliant payment processor (Stripe, Inc.) for the duration of the reservation and for a reasonable period thereafter sufficient to settle any amounts owed under these Terms. Card numbers are tokenized by the processor; the Hotel does not store, transmit, or have access to the full card number, CVC, or magnetic-stripe data. The Guest authorizes the Hotel to charge the card on file, on an off-session basis and without further authorization at the time of charge, for any of the following: (i) the room rate and applicable taxes for nights actually stayed; (ii) the refundable security deposit set forth below; (iii) late-cancellation and no-show fees pursuant to Section II; (iv) in-room consumables, telephone, parking, or other incidentals; (v) cleaning, repair, or replacement charges arising from damage, theft, smoking in non-smoking rooms (Section V), undisclosed pets, or other violations of House Policies; and (vi) any other amount the Guest is liable for under these Terms.
Charge timing. The full room rate plus applicable state and local taxes for the stay is charged at check-in to the card on file, unless the Guest elects to pay at the front desk by an alternative method. The Hotel accepts Visa, Mastercard, American Express, Discover, and cash. The Hotel may, at its discretion, place an authorization hold on the card on file at or before check-in for the anticipated room total plus a reasonable amount for incidentals; any unused portion of an authorization hold is released after check-out in accordance with the issuing bank's processing timelines, which the Hotel does not control.
Refundable security deposit. A refundable security deposit is collected at check-in ($10 for smoking rooms, $20 for non-smoking rooms) and is returned at check-out in the same form as paid, provided the room is left in acceptable condition. The Hotel may apply the security deposit, and any further amount necessary, against damage or policy-violation charges before issuing any balance refund.
Disputes & chargebacks. The Guest agrees that, before initiating a chargeback or payment-card dispute, the Guest will first contact the Hotel in good faith to resolve any disputed charge. The Guest acknowledges that charges authorized under this Section IV and Section II are pre-authorized off-session transactions and are not unauthorized within the meaning of applicable card-network rules.
V. House Policies
- The Hotel is entirely non-smoking except in designated smoking rooms. Smoking in non-smoking rooms incurs a cleaning fee of $250, charged to the Guest.
- Quiet hours: 10:00 PM – 7:00 AM.
- Unauthorized visitors are prohibited in guest rooms after 10:00 PM.
- Guests are financially responsible for any loss of, theft of, or damage to Hotel property caused by the Guest or any member of the Guest's party.
- Pets are accepted only where pre-arranged with the front desk; undisclosed pets may be grounds for cancellation under Section III.
VI. Limitation of Liability
To the fullest extent permitted by applicable law, the Hotel shall not be liable for any loss, damage, theft, or injury to the Guest, members of the Guest's party, or their personal property, except where such loss, damage, or injury results from the Hotel's gross negligence or willful misconduct. In no event shall the Hotel's aggregate liability to any Guest exceed the total room charges paid by that Guest for the stay giving rise to the claim.
VII. Severability
If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be severed and the remaining provisions shall continue in full force and effect. The Parties further agree that a court shall, to the extent permitted by law, reform any such invalid provision to the minimum extent necessary to render it enforceable, preserving the original intent of the Parties.
VIII. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Arkansas, without regard to its conflict-of-laws principles. The Guest and the Hotel agree that any dispute arising out of or relating to these Terms or to any reservation or stay shall be subject to the exclusive jurisdiction and venue of the state and federal courts located in Jefferson County, Arkansas, and each Party hereby waives any objection to such jurisdiction or venue.
IX. Entire Agreement
These Terms, together with the confirmation issued by the Hotel and any posted House Policies, constitute the entire agreement between the Guest and the Hotel with respect to the reservation and stay, and supersede any prior or contemporaneous understandings. No employee or agent of the Hotel has authority to modify these Terms except in a written instrument signed by an authorized representative of the Hotel.
